Unfortunately, it only makes sense that Trump could do this without Congress, then Biden can undo it without Congress and like abortion, it should NOT be a SCOTUS problem. Elections have consequences, Biden pretty much said he would open the border, he was elected and he has. The only way this gets fixed correctly is to have a Congress that is willing to fix it or a POTUS that will re-instate this policy. Either way, it’s an election issue, not a SCOTUS issue.
